In a landmark ruling, Italy’s Constitutional Court has granted legal recognition to same-sex female couples who utilize in vitro fertilization (IVF) procedures abroad. The court’s decision establishes that both partners in a same-sex couple can be legally recognized as parents, even if only one is the biological mother.
The case was brought before the court by a female couple who had conceived a child through IVF treatment outside of Italy. When they attempted to have both of their names registered on the child’s birth certificate, Italian authorities initially refused, recognizing only the biological mother. However, the Constitutional Court has now ruled that this was a violation of the principle of equality and the right to family life.
